ORDER
The petitioners are the accused in C.C.No.1154/2017 on the file of the Judicial First Class Magistrate Court, Thiruvalla arising from Crime No.239/2017 of Pulikeezhu Police Station. The above case is charge sheeted alleging offences punishable under Sections 498A and 294(b) r/w 34 of the Indian Penal Code.
2. The allegation made by the defacto complainant as seen from the First Information Statement are as follows:
(i) The defacto complainant (2nd respondent) has studied up to MBA. She was residing along with her husband in Australia and had come back to her native place due to the harassment of accused persons. It is stated that she was married to the 1st accused, a person settled in Australia.
(ii) Her marriage was held on 20.08.2014, at Condour Resorts, Changanacherry. Initially she and husband had resided in Australia along with his parents and younger brother and later they shifted to a separate house nearby. For about one year after the marriage she was on visit visa to Australia and thereafter in May, 2015 she got spouse visa. After going to Australia on spouse visa, she has returned to her native place only on 07.02.2017.
