This is an application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita , 2023 by accused no.1 in Crime No.318/2025 of Poonthura Police Station which is registered for the offences punishable under Sections 309 (4), 304(2) and 3(5) of Bharatiya Nyaya Sanhita , 2023.
2. Prosecution case is that on 11.03.2025 at 11.00 a.m, accused nos.1 to 3 snatched a gold chain weighing 2 sovereigns worn by the defactocomplainant at the Sri Ujjaini Mahakali Temple, Ambalathara, Muttathara Village. Accused thereby committed the aforesaid offences.
3. The learned Public Prosecutor opposed the bail application on the ground that if bail is granted to the accused who has no permanent place of residence, she may abscond.
4. Heard the learned counsel for the petitioner/accused no.1 and the learned Public Prosecutor.
5. Accused is in judicial custody from 11.03.2025 onwards. Regard being had to the period of detention undergone by the petitioner and also having regard to the progress made in the investigation, this Court is of the view that, grant of bail will not cause any impediment in the process of investigation and a fair and full probe can be well ensured by granting bail to the p
