ORDER

This Criminal Miscellaneous case is filed to quash the proceedings in SC No.409/2014 on the file of the Addl.Sessions Court (Adhoc-III), Kasaragode. The above case is charge-sheeted alleging offence punishable under Sec.306 IPC .

2. The prosecution case is that the wife of the 1st accused committed suicide and this is due to the physical and mental torture attributed by the 1st and 2nd accused against the deceased. The complaint is submitted by the relative of the deceased, who is the uncle of the deceased. Annexure-AII is the final report in this case. The offences alleged in Annexure-AII are under Secs.498A and 306 IPC .

3. When this Criminal Miscellaneous case came up for consideration, the learned counsel appearing for the victims submitted that they are not interested to proceed with the case. This Court directed the Public Prosecutor to verify about the statement and the Public Prosecutor, after getting statement of the victims through the investigating officer submitted that they have no grievance against the petitioners and they do not want to proceed with the case. An affidavit is filed by respondent Nos. 3 and 4 stating that they have no grievance against the petit
