ORDER
This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNSS ’).
2. Petitioner is the 1st accused in Crime No.29/2024 of Binanipuram Police Station alleging commission of the offences punishable under Sections 392 , 212 , 201 r/w Section 34 of the Indian Penal Code .
3. According to the prosecution, on 09.01.2024, at around 7.30 p.m, the 1st accused contacted the de facto complainant and threatened him to transfer Rs.13,000/- by Google Pay and robbed his gold chain weighing two sovereigns after indulging in a homosexual intercourse with him and thereby committed the offences alleged. The petitioner was arrested on 27.03.2025 and has been in custody since then.
4. The learned Public Prosecutor, on instructions, submitted that the Final Report has already been submitted and also that the petitioner is involved in two other crimes committed in 2021 and 2023 and hence bail ought not to be granted.
5. Heard the learned counsel for the petitioner as also the learned Public Prosecutor.
6. Though prima facie there are materials on record to connect the petitioner with the crime, since petitioner has been in custody from 27.03.2025
