Dated this the 25 th day of July, 2024 This Criminal Miscellaneous Case has been filed under Section 482 of the Code of Criminal Procedure, 1973 , to quash Annexure.A1 FIR and Annexure.A2 Final Report in Crime No.231/2023 of Kilikollur Police Station, Kollam, now pending as C.P. No.46/2023 on the files of the Judicial First Class Magistrate Court-I, Kollam.

2.Heard the learned counsel for the petitioners as well as the learned Public Prosecutor, in detail. Perused the complaint and averments therein, in particular.

3.In this matter, the prosecution allegation is that, at about 17.00 hours on 18.02.2023, the accused wrongfully restrained the defacto complainant, his daughter and grand son, who is a minor. It is further alleged that the accused uttered obscene words and broke a beer bottle over the head of the defacto complainant.

On this premise, the prosecution alleges commission of offences punishable under Sections 341, 323, 324, 294(b), 307 read with 34 of IPC and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 [hereinafter referred as ‘JJ Act’ for short].
