JUDGMENT

The petitioner contends that an order of inspection under Section 66 of the Kerala Co-operative Societies Act, 1969, (‘KCS Act’, for brevity) was issued on 07.09.2023 with a direction to enquiry officer to complete the inspection within a period of three months

2. According to the petitioner, Exhibit P2 order was later withdrawn by Ext.P3 order dated 12.10.2023, and the enquiry officer was permitted to conclude the inquiry within a period of three months in respect of the matters mentioned therein.

3. Challenging the above order, the petitioner approached this Court and filed W.P.(C.) No. 40794/2023. This Court, while admitting the matter has ordered that the inquiry initiated under Ext.P3 may go on, but the final orders shall be passed only after obtaining further orders from this Court.

4. The petitioner asserts that while so he has been served with Ext.P5, which is dated 19.01.2024, where reference is made to Ext.P2 order, which has already been withdrawn, and the time to conclude the inquiry initiated as per Ext.P2 has been extended by a period of three months from 07.12.2023.
