ORDER

Dated this the 5 th day of August, 2024 This Criminal Miscellaneous Case has been filed under Section 482 of the Code of Criminal Procedure , 1973, by the petitioners, who are accused Nos.1 to 3 in Crime No.1427/2022 of Aluva East police station, Ernakulam, now pending as C.C.No.901/2023 on the files of the Judicial First Class Magistrate Court-I, Aluva and the prayer herein is as under:

“To quash Annexure A-2 CC No.901/2023 in Crime No.1427/2022 of Aluva Police station on the files of Hon’ble Judicial First Class Magistrate’s Court-I, Aluva, Ernakulam U/s.498A & 34 of IPC”.

2. Heard the learned counsel for the petitioners and the learned Public Prosecutor, in detail. Perused the relevant records.

3. In this matter, the learned counsel for the petitioners produced Annexure A5 Judgment in O.P.No.360/2023 on the files of the Family Court, Ernakulam, dated 8.2.2023, whereby, the learned Family Court Judge, Ernakulam, declared the marriage between the petitioner (2 nd respondent herein) and the respondent (1 st petitioner herein) which was solemnized on 8.5.2022, as dissolved, as per Mubarat agreement, dated 31.1.2023.
