ORDER
Petitioner is the accused in C.P.No.34 of 2024 on the files of the Judicial First Class Magistrate's Court-III (Temporary), Attingal, which arises out of Crime No.1291 of 2022 of Kilimanoor Police Station, Thiruvananthapuram. Petitioner seeks for a direction to the learned Magistrate to consider the application for bail of the petitioner on the date of his surrender.
2. The learned Public Prosecutor, upon instructions submitted that the petitioner had approached this Court in B.A.No.704 of 2023, which was dismissed by order dated 08.02.2023 after noticing nine other criminal antecedents of the petitioner. Thereafter he approached the Supreme Court wherein the special leave petition against the order rejecting his bail application was dismissed with the specific observation that if the petitioner surrenders within three weeks, his regular bail application shall be considered on its own merit, as expeditiously as possible, in accordance with law. Without referring to the aforesaid orders and without producing even the final report, this petition has been filed.
3. I have heard the learned counsel for the petitioner as well as the learned Public Prosecutor.
