ORDER

The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 , by the first accused in Crime No.21/2024 of the Kollam Rural Cyber Police Station, Kollam, which is registered against four accused persons for allegedly committing the offences punishable under Sections 318 (4) & 319(2) of the Bharatiya Nyaya Sanhita, 2023 , and Section 66D of the Information Technology Act, 2000 . The petitioner was remanded to judicial custody on 17.08.2024.

2. The crux of the prosecution allegation is that: on 06.06.2024, the accused, in furtherance of their common intention, had sent a link through Whatsapp to the first informant’s wife. On clicking the link, the first informant was asked to install a mobile application, and the accused secured the first informant’s PAN card and Aadhar card details. Subsequently, they induced the first informant to transfer Rs.13,21,650/- to various bank accounts on the assurance of giving him good profit. However, the accused did not give any profit and refused to return the capital. Thus, the accused have committed the above offences.
