The application is filed under Section 438 of the Code of Criminal Procedure, 1973 , for an order of pre-arrest bail.
2. The petitioners are the accused 1, 2, 5 and 6 in Crime No.232/2024 of the Perambra Police Station, Kozhikode, registered against the accused for allegedly committing the offences punishable under Sections 365 and 506 r/w Section 34 of the Indian Penal Code ( IPC ).
3.The essence of the prosecution allegation is that: on 06.03.2024, at around 14.00 hours, the accused, in prosecution of their common intention, went in three cars and abducted the brother of the defacto complainant, namely Mehanas and his relative Aslam, and enquired about certain monetary transactions that took place abroad, and then assaulted them. Thus, the accused have committed the above offences.
4.Heard; Sri.Rameez Nooh, the learned counsel appearing for the petitioners and Smt. Seetha.S, the learned Public Prosecutor.
