This is the second application seeking regular bail filed by the accused in Crime No. 922/2023 of Town North Police Station, Palakkad, which was registered for the offences punishable under Sections 22(c) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.
2. The allegation against the petitioner is that, on 8.8.2023 at about 7.20 p.m., the petitioner was found in possession of 161.323 grams of MDMA, while the police were conducting a search in front of Shanjana furniture shop, Olavakkode. The petitioner was arrested on 9.8.2023 and since then, he has been under judicial detention.

The earlier bail application was rejected by orders dated 17.10.2023 in B.A.No.8296/2023 finding that 161.323 grams of MDMA was found in possession of him while the police conducted a search in front of a shop. The petitioner was arrested on 9.8.2023. Taking into B. A. No. 2263/2024 ..3.. account the quantity involved, the fact that it was found in possession of the petitioner and the rigour under Section 37 of the NDPS Act, I do not think this is a fit case to grant bail.
