The application is filed under Section 439 of the Code of Criminal Procedure by the sole accused in Crime No.34 of 2024 of the Cyber Crime Police Station, Palakkad, registered against him, for allegedly committing offences punishable under Sections 354D and 506 of the Indian Penal Code , Sections 66E and 67A of the Information Technology Act and Section 120 (O) of the Kerala Police Act . The petitioner was arrested on 10.05.2024.
2. The essence of the prosecution case is that, the accused got acquainted with the de facto complainant (victim) in August 2022 through the social media platform named ‘Pure’. The accused kept constant contact with the victim and gained her confidence. Later, he took the victim to various places and clandestinely took her photographs on his mobile phone. Subsequently, the accused uploaded the photographs of the victim on the social media. Thus accused has committed the above offences.
