Dated this the 06th day of November, 2024 The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita ( ‘the BNS S ’ for short) 2023, by the sole accused in Crime No.865/2024 of the Kallambalam Police Station, Thiruvananthapuram, which is registered against him for allegedly committing the offences punishable under Sections 296 (b), 118(1), 118(2), 329(3), 109 and 74 of the Bharatiya Nyaya Sanhita , 2023 (for short ‘ ’). The petitioner was remanded to judicial custody on 28.09.2024.
2. The essence of the prosecution allegation is that; on 13.09.2024, at around 22:00 hours, the accused trespassed into the house of the defacto complainant, out of his previous animosity, questioned the defacto complainant, and then abused him in obscene language. Thereafter, the accused hit the defacto complainant with a spade on his head and face, and he suffered grievous injuries. When the wife of the defacto complainant attempted to intervene in the matter, the accused grabbed her and pushed her on the ground. Thus, the accused has committed the above offences.
