ORDER

The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, ' BNSS ') by the 1st accused in Crime No.896/2024 of the Adimaly Police Station, Idukki, which is registered against the accused persons for allegedly committing the offences punishable under Sections 318(4), 336(3) and 341 of the Bharatiya Nyaya Sanhita, 2023 (in short, 'BNS'). The petitioner was remanded to judicial custody on 14.09.2024.

2. The prosecution case, in brief, is that: the accused persons, in furtherance of their common intention, had purchased cardamom from the defacto complainant in the month of September 2023. However, the accused failed to pay the price of the product. Thus, the accused has committed the above offences.

3. Heard; Sri.Arundas K.S., the learned counsel appearing for the petitioner and Sri.C.S.Hrithwik, the learned Senior Public Prosecutor.

4. The learned counsel for the petitioner submitted that the petitioner is innocent of the accusations leveled against him. There is no material to substantiate the petitioner's culpability in the crime. In any given case, the petitioner has been in judicial custody for the last more than 60 days, the offence
