JUDGMENT

The petitioner has approached this Court seeking stay of all further proceedings in Ext.P2 execution petition till the disposal of Exts.P4 and P5 applications in Ext.P2 pending before the District Court, Alappuzha.

2. When the matter came up for consideration on an earlier occasion this Court has granted interim order staying further proceedings in the execution petition and also called for a report from the District Court, Alappuzha regarding the present status of Exts.P4 and P5 applications seeking condonation of delay and for granting of stay.

3. A report has been submitted stating that an appeal has been filed, with a delay of 384 days and IA No.1 of 2023 has been filed seeking condonation of the said delay. The petitioner has also filed IA No.2 of 2023 for grant of stay against the final decree proceedings. It is also submitted that appearance of the parties has been completed in IA No.1 of 2023 and the same has been posted for objection and hearing to 19.10.2024.

4. In view of the above facts and circumstances of the case, I am inclined to dispose of the original petition as follows:
