THIS CONTEMPT OF COURT CASE (CIVIL) HAVING COME UP FOR
ADMISSION ON 28.02.2024, THE COURT ON THE SAME DAY DELIVERED THE
FOLLOWING:
When the matter is called for, Sri.Deepu Thankkan – learned counsel appearing for the respondent affirmed that the petitioner is impugning Ext.A5, as having been issued in contravention of the judgment of this Court, only because he was not given an opportunity of being heard. He added that his client is willing to withdraw the same and issue a fresh order.
2.I record the afore submissions and I close the contempt case; however, directing the respondent to implicitly comply with Annexure-
- A3 judgment; thus culminating in an appropriate order and necessay actions thereon, after hearing the petitioner, as expeditiously as is possible but not later than one month from the date of receipt of a copy of this judgment.
3.needless to say, the right of the petitioner to approach this court again in future is left open.
