ORDER

Dated this the 02^nd day of September, 2024 The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (‘the BNS S ’ for short), by the sole accused in Crime No. 2814/2024 of the Adoor Police Station, Pathanamthitta, which is registered against him for allegedly committing the offences punishable under Sections 333 , 294(b), 118(1) and 110 of the Bharatiya Nyaya Sanhita , 2023 (for short ‘ ’). The petitioner was arrested and remanded to judicial custody on 27.07.2024.

2. The crux of the prosecution case is that: on 26.07.2024, at around 21.00 hours, the accused got infuriated towards the son of the defacto complainant, who raised the volume of the Television and caused disturbance to him. Accordingly, the accused entered the house of the defacto complainant and uttered obscene words at the defacto complainant’s son (injured) and took a chopper and attempted to chop him on his head. It is only because the injured had warded off the attack he did not loose his life. However, he suffered injuries on his head. Thus, the accused has committed the above offences.
