ORDER
This criminal miscellaneous case is filed to quash the proceedings in C.C.No.975/2018 on the file of the Judicial First Class Magistrate Court, Chittur, arising from Crime No.209/2017 of Meenakshipuram Police Station, Palakkad. The above case is charge-sheeted against the petitioners alleging offences punishable under Sections 415 , 417 and 420 of the Indian Penal Code .
2. The allegation levelled against the petitioners is that, the petitioners cheated the defacto complainant by providing him with substandard machineries. The 1st Petitioner is the Proprietor of Quality Machines engaged in the business of manufacturing and supplying rice mill machineries to food processing units and the 2nd Petitioner is his son. According to the petitioners, the defacto complainant who was desirous to start a food processing unit in the name and style Premier Agro Industries, placed orders with the 1st petitioner for some machineries and placed quotation for the same. It is alleged by the defacto complainant that, the petitioners, with the intention to cheat the defacto complainant, provided him with low quality/sub standard machineries, which caused financial loss to him.
