ORDER

Petitioner is the accused in Crime No.587/2023 of Palakkad Kasaba Police Station. He faces indictment for the offence under Sec.420 of the IPC. The Prosecution alleges that between 11.04.2022 and 21.05.2022, the accused had cheated the defacto complainant by promising to procure an employment for him at Singapore and collected an amount of Rs.2,70,000/- and thereafter failed to provide the employment or return the money and thereby committed the offece as alleged.

2. Pursuant to the registering of the above crime, petitioner was arrested on 04.04.2024 from Mumbai Airport. At the time of arrest, he was in possession of Rs.2,16,000/- in Indian currency, 540 US Dollars, and 195 Ringgit money, apart from two mobile phones, a gold chain, a gold ring, 3 ATM Cards and cheque leaves, and other articles like wrist watch, which were all seized from him and later produced before the Court. Subsequently, petitioner filed CMP No.5529/2024 in C.C. No.715/2024 seeking release of the articles seized from him under Sec.451 of Cr.PC. By the impugned order dated 09.08.2024, the learned Magistrate directed release of few of the articles and declined to release the foreign currency's and the HDFC A
