ORDER

Petitioners are the accused in C.C. No.484/2018 on the file of the Judicial First Class Magistrate Court-I, Perinthalmanna arising from Crime No.408/2018 of Perinthalmanna Police Station. The above case is charge sheeted against the petitioners alleging offences punishable under Sections 406 & 420 r/w 34 IPC .

2. According to the petitioners, even if the entire allegations are accepted, no offence is made out against the petitioners.

3. Heard the learned counsel appearing for the petitioners and the learned Public Prosecutor.

4. This Court perused Annexure-A FIR and Annexure-B final report. The relevant portion of Annexure-B final report is extracted hereunder:

“2017 മമാർചᨴ᪚ മമാസതᩈ᪌ൽ 1, 2 ്ᩚതᩈ᪌കൾ 1-)O സമാകᩈ᪌യയ ചതᩈ᪌്ᨪണയമ്ᩐ ഉദᩌ᪔ശദതമാടുᨡ കരുതദലമാടുᨡ കൂടᩈ᪌ ്ᩚതᩈ᪌കളുയട മമാനᩈ᪎മുᨡഗലᩈ᪎്ᩦ വവീടᩈ᪌യല അലങമാര പണᩈ᪌കൾ വᩈ᪌ലകൂടᩈ᪌യ യമറവീരᩈ᪌യലുകൾ ഉപദയമാഗᩈ᪌ചᨴ᪚ വമാ്ᨪമാൽ ഉ്ᩦ കരമാർ ്ᩚകമാരുᨡ യചയᩈ᪌പᩈ᪌ചതᩈ᪌നു ദശഷുᨡ 2,55,300/- രൂപ യകമാട്ᨪമായത വᩈ᪌ശശമാസവ്ᨸനയുᨡ ചതᩈ᪌യുᨡ യച്ᩓതമായᩈ᪌ യതളᩈ᪌ഞᩈ᪌രᩈ᪌്ᨪയമാൽ 1, 2 ്ᩚതᩈ᪌കൾ ദമൽവകുപᨴ᪚ ്ᩚകമാരുᨡ ശᩈ᪌കമാർഹമമായ കുറുᨡ യച്ᩓᩈ᪌രᩈ᪌ᨪ᪎ᩐ᪎ എ്ᩐᨴ᪚.”

5. The question to be decided in this case is whether the offences under Sections 406 and 420 IPC are made out, even if the entire allegations
