Dated this the 7th day of October,2024 The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 , by the sole accused in Crime No. 1338/2024 of the Karunagappally Police Station, Kollam, which is registered against him for allegedly committing the offences punishable under Sections 74 , 115(2), 351(2), 62 & 69 of the Bharatiya Nyaya Sanhita, 2023 (in short, ‘BNS’). The petitioner was arrested and remanded to judicial custody on 21.09.2024.

2. The prosecution case, in brief, is that: on 11.08.2024, at around 16:00 hours, while the accused was working as an electrician in the house of the survivor, he called the survivor near him, and caught hold of her, bit her lips, groped her breasts, and outraged her modesty. Thus, the accused has committed the above offences.

3. Heard; Smt.Ummul Fida, the learned counsel appearing for the petitioner and Smt. Seetha S., the learned Senior Public Prosecutor.

4. The learned counsel for the petitioner vehemently argued that the petitioner is totally innocent of the accusations levelled against him. There is no material to substantiate the petitioner’s culpability in the crime. The present crime has been fals
