O R D E R

This revision under Section 397 and 401 Cr.P.C. has been filed by respondent/wife against the judgment dated 09/07/2020 in Crl.Appeal No.221/2019 on the file of the Court of Session, Kozhikode, which appeal was against the order dated 02/04/2019 in M.C.No.68/2015 on the file of the Judicial First Class Magistrate Court-III, Kozhikode. The parties in this petition will be referred to as described in M.C.No.68/2015.

2. M.C.No.68/2015 under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (PWDV Act) was filed by the petitioner herein/wife against her husband, the respondent herein. The marriage between the petitioner and the respondent was solemnized on 29/08/1999 as per the rites and customs of the community to which they belong. In the wedlock, two children were born. After the marriage, the petitioner and the respondent resided in the house of the respondent. The respondent/husband purchased 7 cents of land and constructed a house therein by utilizing the money of the petitioner as well. The petitioner had 100 sovereigns of gold ornaments which was sold by the respondent/husband for the purpose of the construction of the house. Apart from the same, w
