JUDGMENT

Raja Vijayaraghavan, J.

The appellant is the respondent in O.P.No. 1915/2013 on the file of the Family Court, Ernakulam. This appeal has been filed being aggrieved by the judgment dated 7.3.2024 passed by the Family court. By the aforesaid judgment, the Family court has declared that the marriage between the petitioner and the respondent solemnized on 8.9.2018 has been dissolved as per “Khula” pronounced by the respondent on

17.6.2023.

2. Sri. Bobby Raphel, the learned counsel appearing for the appellant submitted that the Family court has not decided the matter on its merits, but has merely held that if the appellant is aggrieved by the declaratory decree endorsing the Khula, he is at liberty to initiate appropriate proceedings. The learned counsel contends that the appellant had preferred an application seeking to stay all further proceedings as O.P.No. 2578/2022 instituted by the appellant seeking declaration and other reliefs was pending before the Family court. It is submitted that the court has acted in haste and without considering the valid objections raised by the appellant.

3. We have heard the learned counsel appearing for the respondent and have perused the records.
