ORDER

Dated this the 16th day of April, 2024 Under challenge in this Crl.M.C is Annexure-A2 order, which dismissed the petitioner's application for release of passport surrendered before the Judicial First Class Magistrate Court- II, Paravur.

2. The petitioner is the sole accused in Crime No.1192/2023 of Paravoor Police station, Kollam district for offenses alleged under Section 376 , 376(2)(n) and 506(i) of the Indian Penal Code . As per Annexure-A1 order, the petitioner was granted regular bail. One of the conditions for grant of bail was that, the petitioner shall surrender his passport before the jurisdictional Court, which condition was complied with.

3. The petitioner filed C.M.P.No.175/2024 seeking release of his passport, for the purpose of renewal of the same. It is averred that, his passport expired on 24.02.2024, a copy of which is produced as Annexure-A3 herein. The same was dismissed by the learned Magistrate vide Annexure- A2 order finding that, the final report has already been filed and that no direction has been issued by the High Court for release of passport, while granting bail.
