ORDER
Dated this the 6th day of December, 2024
The petitioner’s vehicle, a tanker lorry has been seized in connection with Crime No.712/2024 of Mararikulam Police Station, registered for the offences punishable under Sections 271 , 280 read with Section 62 of the Bharatiya Nyaya Sanhita , 2023 and Section 120 (e) of the Kerala Police Act , 2011.
2. The allegation is that the petitioner attempted to discharge night soil from his lorry by the side of the National Highway. The petitioner’s application for interim custody of his vehicle stands dismissed by Annexure-3 order. Hence, this Criminal Miscellaneous Case.
3. Learned Counsel for the petitioner submitted that the vehicle was seized on 25.07.2024 and is lying in the police station premises, exposed to rain and sun. It is submitted that the petitioner is ready and willing to comply with any condition to be imposed by this Court and no purpose will be served by the vehicle remaining idle.
4. Learned Public Prosecutor submitted that the offences are to be viewed seriously,
