O R D E R

The transfer petition is filed under Section 24 of the Code of Civil Procedure,1908(in short, 'C.P.C.'), seeking to transfer O.S.No.149/2021 (Annexure-A1), from the Court of the Subordinate Judge, Thiruvananthapuram, to the Court of the Subordinate Judge, Kollam or any other court in the State, as this Court deems fit and proper.

2. The petitioner’s case, in brief, in the memorandum of transfer petition is that, he is the sixth defendant in the above suit, which is filed by the first respondent. The respondents 2 to 6 are the defendants 1 to 5 in the suit. The first respondent has instituted Annexure-A1 plaint, for a decree for damages. The first respondent has threatened the petitioner for ransom and has proclaimed to wreck vengeance on him. The petitioner’s house was attacked by antisocial elements. His life was saved due to the timely intervention by the people of his locality. The first respondent has also filed a false complaint against the petitioner. Actually, the first respondent has been implicated in a crime. The cause of action for the suit has arisen in whole within the jurisdiction of the courts at Kollam.
