This application is filed under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail.
2. The petitioners are accused Nos. 1 and 2 in Crime No.1465/2023 of Kottarakara Police Station, Kollam District, for having allegedly committed offences punishable under Sections 406, 409, 420 r/w Section 34 of the Indian Penal Code.
3. The prosecution case is that the 1st petitioner is the Principal of a Self Financing B.Ed College, and the 2nd petitioner is the Superintendent of the said College. The 2nd respondent is the Manager of the said College. There were some personal issues between the petitioners and the 2nd respondent. Therefore, the 2nd respondent is trying to harass the petitioners. The 2nd respondent issued Annexure A7 letter, asking the 1st petitioner to retire from his post of Principal at the age of 56. According to the 2nd respondent, the retirement of teachers in Self Financing College is at the age of 56, as in the case of State Government employees. Annexures A8, A9, and A10 would show that the retirement of the teaching staff of Self Financing College is at the age of 65.
