JUDGMENT
Petitioners had been running poultry pig and diary farm since
2011 and had obtained the licence from the concerned Grama Panchyath under the then relevant and applicable bye law/Act, Rules. In 2011, an application for renewal of licence for the period 2012-13 was submitted. But during the pendency of the same, Grama Panchayth issued a notice in respect of a complaint of local residents, though the details of the same was not given. The aforementioned notice was duly replied but again a notice Ext.P4 was received, which was also replied with the same reply of being not satisfactory. An appeal was preferred before the second respondent which was rejected much less revision, which also has been dismissed.
2. Learned counsel appearing on behalf of the petitioner submits that, in the meantime, Livestock Farm Rules had come into force with effect from 13.4.2012. The aforementioned Rules, permit the person to carry on the Farm, if the number of the cattles do not exceed 5, goat 20 and Pigs 5. Owing to the COVID pandemic there has been a considerable reduction of the animals. The authorities cannot keep the application for renewal of the licence in the manner or holding any enquiry
