HIGH COURT OF KERALA
ALEXANDER THOMAS, C. JAYACHANDRAN, JJ
SANTHINI DEVI K. – Appellant
Versus
UNION OF INDIA – Respondent
OP (CAT) 75 2023

Advocates:
V.JAYADHAR HAFY PUNTHALA, WILSON G. PRADEEP KUMAR

Promotion to the IPS must not result in reduced pay; existing legal principles mandate that pay must reflect previous earnings and not fall below certain thresholds.

Headnote:

Pay - Promotion to IPS - Union of India v. T.M.Somarajan & Ors. - Sections of the IPS (Pay) Rules - The court emphasized the principles established in T.M.Somarajan related to pay fixation upon promotion, asserting that officers cannot have their pay reduced post-induction into IPS, leading to a remand for proper compliance with existing legal frameworks.

Fact of the Case:

The petitioner challenged a Tribunal order which upheld a lower pay fixation after his promotion from Kerala Police Service to Indian Police Service, arguing non-compliance with earlier judicial principles regarding pay fixation.

Finding of the Court:

The court found that the Tribunal erred in accepting the respondents' claims regarding pay fixation based on unequal pay structures, and emphasized the petitioner’s right to pay under the principles established in the T.M.Somarajan case.

Issues: Whether the Tribunal's order to uphold a lower pay fixation for the petitioner violated the established principles of pay determination upon induction into the IPS.

Ratio Decidendi: The court held that the failure to adhere to the T.M.Somarajan principles, which protect against pay reduction upon induction into IPS, constituted a legal oversight that warranted judicial reconsideration.

Final Decision: The impugned order was set aside and the matter remitted for fresh consideration.

JUDGMENT

C.Jayachandran, J.

Ext.P12 order of the Central Adminstrative Tribunal dated 07.11.2022, rendered in Miscellaneous Application No.484/2020 in O.A. No.923/2014, is under challenge in this Original Petition. The said Original Application was premised on the ground that the petitioner's pay, pursuant to his promotion from the Kerala Police Service to the Indian Police Service, was fixed on a scale lower than the one he was drawing in the State service. As per Ext.P1 Order dated 07.01.2016, the Tribunal held that the petitioner is entitled to have his pay fixed in accord with the principle laid down inUnion of India v. T.M.Somarajan & Ors. [ 2010 (1) SCC 129 ] and directed the respondents to fix the pay accordingly, taking into account the amended rules as well. However, the pay scale fixed in compliance of Ext.P1 order was also lower than his previous scale in the State service. The 4th respondent Accountant General contended that his total emoluments is, however, more than what he received in the State service. The Tribunal, vide the impugned Ext.P12 Order, accepted the above compliance of Ext.P1 order, challenging which, the petitioner is before us in the afore captioned Original Petition.
