This application is filed under Section 439 of the Code of Criminal Procedure , seeking regular bail.

2. The petitioner is the 3rd accused in Crime No. 47/2021 of Excise Enforcement and Anti Narcotic Special Squad, Palakkad District, for having allegedly committed offences punishable under Sections 20 (b) (ii)(c), 27A, 28, 29 and 30 of the Narcotic Drugs and Psychotropic Substances Act .

3. The allegation against the petitioner is that the accused 1 to

10 entered into a criminal conspiracy for possessing and transporting ganja from Andhra Pradesh to Kerala, and in furtherance of their conspiracy amongst themselves, accused nos. 6,7 and 8 arranged for financial aid to purchase the Ganja, and the first accused transported the Ganja from Andhra Pradesh with the assistance of accused nos. 2 to 6, 9 and 10 on a tourist bus driven by the 01st accused and in two cars during which they were intercepted by the second respondent on 12/09/2021 at about 07:25 am along the Salem-Kanyakumari NH at Padinjare Yakkara whereupon inspection altogether 145.5 kgs of dried Ganja was found and seized and thereby, the petitioner committed the alleged offences.
