JUDGMENT

Ext.P12 order of the Central Adminstrative Tribunal dated 07.11.2022, rendered in Miscellaneous Application No.484/2020 in O.A. No.923/2014, is under challenge in this Original Petition. The said Original Application was premised on the ground that the petitioner's pay, pursuant to his promotion from the Kerala Police Service to the Indian Police Service, was fixed on a scale lower than the one he was drawing in the State service. As per Ext.P1 Order dated 07.01.2016, the Tribunal held that the petitioner is entitled to have his pay fixed in accord with the principle laid down inUnion of India v. T.M.Somarajan & Ors. [ 2010 (1) SCC 129 ] and directed the respondents to fix the pay accordingly, taking into account the amended rules as well. However, the pay scale fixed in compliance of Ext.P1 order was also lower than his previous scale in the State service. The 4th respondent Accountant General contended that his total emoluments is, however, more than what he received in the State service. The Tribunal, vide the impugned Ext.P12 Order, accepted the above compliance of Ext.P1 order, challenging which, the petitioner is before us in the afore captioned Original Petition.
