Versus
STATE OF KERALA – Respondent
Crl.MC 8325 2023
ANOOP.V.NAIR, TANOOSHA PAUL, ROHITH C.AVANTHIKA R.
Prosecution under the Food Safety and Standards Act is unsustainable if actions are compliant with newly amended regulations.
Headnote:
Food Safety - Criminal Proceedings - Food Safety and Standards Act, 2006 - Sections 3, 26, 27, 30, 31, 59, 63 - The court quashed proceedings against the petitioners under the FSSA as the alleged violations were in conformity with updated standards allowing certain preservatives in soy sauce.
Fact of the Case:
Petitioners were accused of selling unsafe soyabean sauce under the Food Safety and Standards Act. A charge sheet was filed after samples were deemed unsafe, but amendments to food safety standards later made their actions compliant.
Issues: Whether the petitioners violated the Food Safety and Standards Act despite amendments allowing certain preservatives in food items.
Ratio Decidendi: The court ruled that prosecutions based on prior standards were unsustainable if the actions were no longer violations under the amended regulations of the Food Safety and Standards Act.
Final Decision: Proceedings against the petitioners in C.C.No.807/2021 have been quashed.
