The respondents in O.P.No.799 of 2019 before the Family Court, Ottapalam, has filed this Original Petition under Article 227 of the Constitution of India . They seek to set aside Ext.P5 order of the Family Court dated 15.12.2022 in I.A.No.7 of
2021 in O.P.No.799 of 2019.
2. On 01.02.2023, notice on admission was directed to be served on the respondents. Today, the respondents entered appearance through their learned counsel.
3. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondents.
4. The 1st respondent is the wife of the petitioner. The
2nd respondent is their child, aged 4 years. O.P.No.799 of 2019 was filed by the respondents claiming maintenance. It was alleged that the 1st respondent was compelled to depart the company of the 1st petitioner as a result of his cruel acts. In the original petition, the respondents have filed I.A.No.7 of
2021 seeking interim maintenance and litigation expenses. The 1st respondent claimed Rs.15,000/- per month and the 2nd respondent claimed Rs.8,000/- per month. Litigation expense of Rs.20,000/- was also claimed. The 1st petitioner filed objection opposing the said cla
