Dated this the 30th day of October, 2023 This is an application for anticipatory bail.

2. The petitioner is the accused in Crime No.806 of

2023 of Aluva East Police Station, Ernakulam District, alleging commission of offence punishable under Section

376(2)(n) of the Indian Penal Code .

3. The allegation against the petitioner is that the petitioner got acquainted with the victim through a social media platform and thereafter, entered into sexual relationship with the victim upon a false promise of marriage.

4. The learned counsel appearing for the petitioner would submit that the petitioner is a Sub Lieutenant in the Indian Navy and he is currently undergoing OEM (Original Equipment Manufacturer) training of Batch 1 of the officers for the upcoming Naval Shipborne Unmanned Aerial Systems (NSUAS). It is also submitted that the relationship between the petitioner and the victim was purely consensual and there is no element of rape as alleged. It is further submitted that after the relationship between the petitioner and the alleged victim became known to the parents of the petitioner and the victim, they had opposed the relationship between the petitioner and the victim and therefo
