ORDER

The petitioner is the 4th accused in Crime No.814/2020 of Thanur Police Station which is now pending before the Judicial First Class Magistrate Court I, Parappanangadi as L.P. No.44/2022. The aforesaid crime was registered against the petitioner and other accused for the offences punishable under Sections 143, 147, 148, 323, 324 and 308 and Section 149 of Indian Penal Code.

2. Even though the petitioner was granted anticipatory bail, during the crime stage, he could not appear before the court and execute the bond as he was working abroad. Now the final report has been submitted, and since the petitioner did not appear, non bailable warrant is also issued against the petitioner. The case is now included in the long pending register as well. The petitioner now expresses willingness to surrender before the court and to cooperate with the trial. However, the apprehension of the petitioner is that, as the case is already included in long pending register he is likely to be detained in the event of such surrender. Therefore, he seeks for a direction in this Crl.M.C. to consider the bail application to be submitted by the petitioner before the learned Magistrate on the date of surren
