ORDER
Petitioners are the accused 1 to 6, 9 to 23, 25 to 40 in Crime No.192/2011 of Ambalavayal police station, now re-registered as CBCID crime No.475/2011 of CBCID, Kozhikode pending before the Judicial Magistrate's Court, Kalpetta. The crime was originally registered on the complaint preferred by the 4th respondent alleging offence under Section 420 read with 34 of the IPC . It is alleged that the accused persons had enrolled the defacto complainant in the RMP network after collecting Rs.5,490/-, offering that he will be given products worth the amount paid by him after making him believe that he will get huge dividend through the network.
2. During the course of investigation, it came out that offences under Sections 3 , 4, 5 and 6 of the Prize Chits and Money Circulation Scheme (Banning) Act also are invoked and that the investigation is in progress. Now stating that the entire dispute is settled with the defacto complainant and other affected persons, they have moved this Court for quashing the proceedings under Section 482 of the Cr.P.C.
