J U D G M E N T

The petitioners in W.P.(C) No.13523/2019 and the third respondent therein are rival stage carriage operators. The said writ petition has been filed alleging illegal operation of services by the third respondent in deviation of the permit route. The third respondent therein has filed W.P.(C) No.15197/2018 seeking rectification of alleged error regarding the route in the permit issued to him. For the sake of convenience, the petitioners in W.P.(C) No.13523/2019 is referred to as, “the petitioners”, and petitioner in W.P.(C) No.15197/2018 who is the third respondent in W.P.(C) No.13523/2019 is referred to as, “the third respondent”. The exhibits referred to are those produced in W.P.(C)No.15197/2018.

2. Heard Sri.O.D.Sivadas, the learned counsel for the petitioners, and Sri.I.Dinesh Menon, the learned counsel for the third respondent and Sri.Bimal K. Nath, the learned Senior Government Pleader.

3. The third respondent operates on the route Aluva-Fort Kochi. Going by the permit issued in favour of the third respondent, Exhibit P1, his route is via “Kaloor-Kadavanthra Road”. In deviation of the route, he is operating via “Menaka”, is the allegation.
