Dated this the 17th day of November, 2022 The petitioner has approached this Court being aggrieved by the fact that the proposal submitted by the petitioner for One Time Settlement has been arbitrarily rejected by the competent authority of the respondent bank by vaguely requiring the petitioner to apply for One Time Settlement as per the norms of the bank. It is submitted that there are no published norms and since the petitioner’s unit is an MSME unit, it is entitled to the benefit of Ext.P6 circular including consideration under a non-discretionary One Time Settlement Policy. It is also pointed out that the property of the petitioner is scheduled to be sold on 23.12.2022 by fixing a reserve price of Rs.73,00,000/-. It is submitted that the petitioner has a buyer who is willing to purchase the property for a sum of Rs.75,00,000/-. It is also submitted that the respondent bank is proposing to take the physical possesion of the secured asset on 18.11.2022 (tomorrow).
