HIGH COURT OF KERALA
STATE OF KERALA – Appellant
Versus
SOMASUNDARAN – Respondent
LA.App. 509 2014
The judgment established that land classification and market potential are critical in determining compensation under land acquisition law.
Headnote:
Compensation - Land Acquisition - Kerala Land Acquisition Act, 1961: Sections 54 & 23(1A) - The court analyzed land valuation and classification for compensation assessment under the Kerala Land Acquisition Act, determining that enhancements were justified based on the properties' market potential and location.
Fact of the Case:
Land Acquisition Appeals were filed by the State and claimants concerning the compensation awarded for lands acquired for widening the Kovoor-Vellimadukunnu Road. The acquired properties were claimed for enhanced compensation following a notification under the Kerala Land Acquisition Act, 1961.
Issues: The main issues were whether the classification of lands as garden land was appropriate and if the compensation awarded by the Reference Court was justifiable or needed enhancement.
Ratio Decidendi: The classification of the acquired lands as garden land was appropriate despite being registered differently, and the evidence supported a higher compensation based on their commercial potential.
Final Decision: Compensation was enhanced to Rs.4,50,000/- per cent with additional statutory benefits.
