ORDER
Against the concurrent findings of guilt, accused Nos.
1 and 4 in C.C. No. 340 of 2012 on the file of the Judicial First Class Magistrate's Court-I, Peerumedu have moved this revision under Sections 397 and 401 of the Cr.P.C. Crime No. 288 of 2009 of Peerumedu police station was registered alleging offences punishable under Sections 294 (b), 341, 323, 324 read with 34 of the IPC . The alleged incident had happened on 24.06.2009 at 5.30 PM. It is alleged that the accused persons, four in number, in furtherance of their common intention, wrongfully restrained, assaulted, and injured the de facto complainant John Simon, who was examined as PW1.
2. The precise allegation is that out of previous animosity, while the said John Simon was proceeding to pick his daughter from Vedikuzhi, at the place by name Kolahalamedu, the 1st accused, that is the 1st petitioner, uttered obscene words against him and fisted on his left eye and the 4th accused stabbed him with a knife above his left eye and caused him injuries. The 4th accused also pushed him down and at that time the 2nd accused, the wife of the 1st accused, wrongfully restrained him and the 3rd accused hit him with a granite piece on
