As both these OP(KAT)'s preferred by the State impugn the common order dated 31.01.2022 in O.A.No.743 of 2020 and O.A.No.886 of 2019 respectively, they are taken up for consideration together and disposed by this common judgment.
2. The brief facts necessary for the disposal of these OP(KAT)'s are as follows:
The applicants before the Tribunal were Junior Residents/Staff Nurses appointed on contract basis in the erstwhile Ernakulam Medical College under the management of the Co-operative Academy of Professional Education (CAPE). The said establishment was taken over by the Government with effect from 17.12.2013 (Annexure -A2). It is not in dispute that at the time of takeover of the establishment by the Government, the applicants before the Tribunal were working on contract basis in the establishment, and thereafter, at the time of approaching the Tribunal, the applicants continued to be engaged on contract basis by the establishment which subsequently came to be known as the Government Medical College, Ernakulam.
