VIJU ABRAHAM, J
SHAJAN – Appellant
Versus
STATE OF KERALA – Respondent
Bail Appl./8942/2022
AJEESH M UMMER, SR.M.C.ASHI - PP
Anticipatory bail can be granted under stringent conditions in serious offence cases if the accused is not likely to obstruct justice.
Headnote:
Bail - Anticipatory Bail - IPC Sections 341, 323, 324, 363, 452, 34 - Court grants bail with stringent conditions while considering the nature of allegations.
Fact of the Case:
The petitioner, accused in a severe criminal case involving assault and trespass, sought anticipatory bail claiming false implication due to personal disputes and prior complaints against the defacto complainant. Allegations included serious physical harm inflicted by multiple individuals.
Finding of the Court:
The court weighed the serious nature of the allegations against the petitioner's lack of prior criminal history. It determined that while bail was warranted, it should be conditional due to the circumstances and gravity of the claims.
Issues: The primary issue was whether anticipatory bail should be granted in light of the severity of the charges and the petitioner’s claims of false accusation.
Ratio Decidendi: The court affirmed the principle that anticipatory bail can be granted even in serious offences if the accused is not likely to abscond or influence witnesses, alongside the necessity of conditions to mitigate risks of tampering with investigation.
Final Decision: Application for anticipatory bail allowed with stringent conditions.
