HIGH COURT OF KERALA
A. Muhamed Mustaque, Shoba Annamma Eapen, JJ
STATE OF KERALA – Appellant
Versus
P.M.SUBAIR – Respondent
LA.App. 267 2016

Advocates:
SMT.N.SUDHADEVI, GOVERNMENT PLEADER SRI.K.A.JALEEL, ADDL. ADVOCATE GENERAL

The court emphasized proper classification of acquired land and affirmed enhanced compensation based on its developmental potential and comparability to market rates post-notification.

Headnote:

Land Acquisition - Kerala Land Acquisition Act - Sections 23(1A), 54 - The court assessed the correctness of the compensation awarded for land acquisition, emphasizing that the enhanced values given by the Reference Court were justified based on the location and potential of the acquired lands.

Fact of the Case:

162 land acquisition appeals arose from a notification for the widening of Kovoor-Vellimadukunnu Road, where the State challenged the enhanced compensation awarded, while claimants contested the inadequacy of the amounts awarded by the Reference Court.

Finding of the Court:

The court determined that the classification of acquired lands as garden land was appropriate and found the Reference Court's enhancement of the compensation to be justified, taking into account the area's development and potential value.

Issues: Whether the classification of acquired lands and the compensation fixed by the Reference Court were correct.

Ratio Decidendi: The classification of lands as garden land was upheld due to the area's developmental significance, and the enhanced compensation was affirmed based on comparability to market values of nearby properties.

Final Decision: Compensation enhanced to Rs.4,50,000/- per cent with statutory benefits, and the appeals filed by the State were partly allowed.
