ORDER
This is an application for regular bail.
2. Petitioner is the accused in the Crime No.391 of 2022 of Palarivattom Police Station registered alleging commission of offence punishable under Section 392 of the Indian Penal Code.
3. The crux of the allegation raised in the case against the petitioner is that on 15.04.2022 at about 12.30 p.m. at Palarivattom YMJ Stadium Link Road the petitioner/accused had snatched 1.5 sovereign of gold chain worth Rs.60,000/- worn by the defacto complainant and thereby the petitioner committed the offence punishable under Section 392 IPC. Petitioner herein was arrested in connection with the crime on
19.04.2022 and is remaining in custody since then.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The learned Public Prosecutor upon instruction submitted that the charge is already laid and that he has no previous antecedents
6. It is seen that the petitioner is in custody from 19.04.2022 onwards. Having regard to the facts and circumstances of the case, considering the nature of the allegations and considering the fact that the petitioner is in custody from 19.04.2022 onwards, I am inclined to grant bail to the petitioner on the following conditions:
(i) The petitioner shall execute a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like-sum to the satisfaction of the jurisdictional court;
(ii) The petitioner shall surrender his passport before the jurisdictional court. If the petitioner has no passport, he shall execute an affidavit to that effect and file the same before the said court within seven days of release on bail.
(iii)He shall not attempt to interfere with the investigation or to influence any witness in Crime No. 391 of 2022, Palarivattom Police Station;
(iv) He shall not involve in any other crime while on bail.
If any of the aforesaid conditions are violated, the investigating officer in Crime No. 391 of 2022, Palarivattom Police Station may file an application before the jurisdictional court, for cancellation of bail.
