JUDGMENT
This appeal arises from the judgment passed by the Additional Sessions Court Fastrack (Adhoc) No.II, Thiruvananthapuram in Sessions Case No.2000/2001. The appellant herein is the accused No.1. During the course of proceedings, the appellant died.
2. This appeal was dismissed by this Court as per judgment dated 06.03.2014.
3. The wife of the appellant Smt. Girija A., challenged the judgment dismissing the appeal before the Supreme Court in Crl.Appeal No.77/2020. The Apex Court, as per judgment dated 21.01.2020, set aside the judgment of this Court dated 06.03.2014 and remanded the matter to this Court for hearing afresh, after giving opportunity to the legal heirs of the accused.
4. Adv. Sandhya E.S. appeared for the daughter of the accused.
5. Heard the learned counsel on both sides.
6. The prosecution case is that, on 13.12.2000 at about 11.25 p.m., the appellant/accused No.1 and the other accused were found engaged in manufacturing illicit arrack for the purpose of sale at Kaliyilthitta House owned and possessed by the appellant/accused No.1 in Kizhuvilam Village. Accused No.1 was arrested from the scene.
