ORDER

This is an application for regular bail.

2. The petitioner is the 7th accused in Crime No.1472 of 2021 of Angamaly Police Station, Ernakulam registered for the offences punishable under Sections 20(b)(ii)C and 29 of the Narcotic Drugs and Psychotropic Substance Act , 1985 (in short, “NDPS Act”).

3. The FIR was initially registered against A1 to A3 on the allegations that they were found transporting 225.380 kgs of cannabis on 8-11-2021 at 7.45 a.m. Subsequently, the offences under Sections 8(c), 27A and 31(I) of the NDPS Act were added and thereafter implicated 5 more accused in which the petitioner was made 7th accused based on a confession statement of the co-accused that out of the total contraband, 121.594 kgs of cannabis was sold to them by the petitioner.

4. It is submitted by the petitioner that he is totally innocent and the allegations against him are false. The police had issued notices to the petitioner and his brother, Balorda Harichandar to implicate them in the alleged offence. On receipt of the notices, they approached this Court by filing B.A No.904 of 2022. Thereafter, the Excise Crime Branch, Kozhikode tried to implicate them in CR No.30 of 2021 also. The petit
