ORDER

The petitioner is the 1st accused in Crime No.709/2022 of Kollam West Police Station which was registered against the petitioner and other accused for the offences punishable under Sections 143 , 147, 148, 294(b), 506, 427, 323, 353, 332 read with Section 149 of Indian Penal Code and also under Sections 3(1) and 3(2)(e) of Prevention of Damages of the Public Properties Act, 1984. The petitioner was arrested as part of the investigation of the said case and he was released as per Annexure A3 order dated 13.10.2022 by the Judicial First Class Magistrate Court III, Kollam subject to certain conditions. One of the conditions was that, the petitioner shall furnish cash security for Rs.35,000/- (Rupees thirty five thousand only) before the court which was the estimated loss of the public property. The petitioner filed this Crl.M.C. challenging Annexure A3 order to the extent it imposes the condition of deposit of Rs.35,000/-.
