JUDGMENT

The above writ petition is filed with following prayers :

i) Call for the records pertaining to Ext P 5 and P 5A and set aside the same.

ii) Issue a writ of mandamus, any other writ, order or direction, directing the 2nd Respondent to Re Consider the application of the Petitioner for building permit within a time frame by taking account of the distance of

50 meters from HTL, as per CRZ 2019 Notification.

iii) Issue a writ of mandamus, any other writ, order or direction declaring that the distance rule/distance from HTL in CRZ III on landward side of tidal influenced water bodies is 50 meters in any event of finalization of new Coastal Zone Management Plan.

iv) Issue a writ of mandamus, any other writ, order or direction, directing the 2nd Respondent to Re-consider the application for building permit within a time frame by taking account of the distance of 50 meters from HTL, as per CRZ 2019 Notification and issue PROVISIONAL permit to the Petitioner.

v) Issue a writ of mandamus, any other writ, order or direction, directing the 1st and 2nd Respondents to complete the process of public hearing and finalization of Coastal Zone Management Plan of 2019, especially of
