JUDGMENT
The issue in these two cases is with regard to the entitlement to the compensation granted on acquisition of properties. The petitioners in either of these writ petitions are laying a claim. In such circumstances, the only option available under Section 3H (4) of the National Highways Act , is for the authority to refer the matter to the competent Civil Court for decision.
In such circumstances, the Competent Authority for Land Acquisition (CALA) is directed to refer the matter regarding compensation payable with respect to the acquisition in question, to the competent Civil Court within three weeks from the date of receipt of a copy of this judgment.
This writ petition is disposed of as above.
