HIGH COURT OF KERALA
T. R. Ravi, J
BEENA.P.S – Appellant
Versus
THE REGISTRAR OF CO-OPERATIVE SOCIETIES – Respondent
JUDGMENT
The prayer in the writ petition is to permit the petitioners to pay off of the amounts outstanding in easy instalments. The Standing Counsel for the 4th respondent on instructions submits that an amount of Rs.16,08,100/- is the amount due as on date. It is also submitted that they have no objection if the petitioners are permitted to repay in instalments, provided, the petitioners make the payment regularly and also pay the future interest.
In the above circumstances, the writ petition is disposed of permitting the petitioners to pay off the amounts due to the 4th respondent along with future interest in 15 equal monthly instalments, the first instalment falling due on or before 20.11.2022 and the subsequent instalments falling due on or before the 20th of the succeeding months. If the petitioners make two consecutive defaults in the payment of the instalments, the 4th respondent is at liberty to proceed with coercive steps for recovery. The coercive steps initiated shall be kept in abeyance to facilitate the payment of instalments as directed above.
